TERMS AND CONDITIONS FOR ACCOMMODATION CONTRACTS

SCOPE OF APPLICATION

Article 1

  1. Contracts for Accommodation and related agreements to be entered into between this Hotel and the guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided for herein shall be governed by laws and regulations and generally accepted practices.
  2. In the case when the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices, not withstanding the preceding Paragraph, the special contract shall take precedence over the provisions of these Terms and Conditions.

APPLICATION FOR ACCOMMODATION CONTRACTS

Article 2

  1. Since the duty for reserving a hotel register is imposed, a Guest who intends to make an accommodation contract with the Hotel shall notify the Hotel of the following particulars in accordance with regulations outlined in Article 6. (An operating company has to submit a hotel register, the lodger's name, address, occupation, and any other related matters pertaining to demands by a government official or government member.)
    • (1) Name of the Guest (s)
    • (2) Dates of accommodation and estimated time of arrival
    • (3) Any other particulars deemed necessary by the Hotel
  2. In the case when the Guest requests during his or her stay, extension of the accommodation beyond the date in subparagraph (2) of the preceding Paragraph, it addition, the personal information offered by the visitor will not be disclosed to a third party without the principal visitor's consent. However, in the following cases, a visitor's personal information may be disclosed to a third party:
    • (1) When the formal reference based on law is received from a public organization, such as the police or the court.
    • (2) When there is a necessary urgency for all parties involved.

CONCLUSION OF ACCOMMODATION CONTRACTS, ETC.

Article 3

  1. A Contract for Accommodation shall be deemed to have been concluded when the Hotel has duly accepted the application as stipulated in the preceding Article. However, the same shall not apply where it has been proved that the Hotel has not accepted the application.
  2. When a Contract for Accommodation has been concluded in accordance with the provisions of the preceding Paragraph, the Guest is required to pay an accommodation deposit fixed by the Hotel within the limits if Basic Accommodation Charges covering the Guest's entire period of stay (or covering 3 days when the period of stay exceeds 3 days) by the date specified by the Hotel.
  3. The deposit shall be used first for the Total Accommodation Charges to be paid by the Guest, secondly for the cancellation, if any, shall be refunded at the time of the payment of the Accommodation Charges as stated in Article 12.
  4. When the Guest has failed to pay the deposit by the date as stipulated in Paragraph 2, the Hotel shall treat the Accommodation Contract as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel of the specific period for payment of the deposit.

SPECIAL CONTRACTS REQUIRING NO ACCOMMODATION DEPOSIT

Article 4

  1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded as stipulated in the same Paragraph.
  2. In the case when the Hotel has not requested the payment of the deposit as stipulated in Paragraph 2 of the preceding Article or has not specified the date of the payment of the deposit at the time the application for an contract as prescribed in the preceding Paragraph.

REFUSAL OF ACCOMMODATION CONTRACTS

Article 5

  1. The Hotel reserves the right to refuse an Accommodation Contract in any of the following cases:
    • (1) When the application for accommodation does not conform with the provisions of these Terms and Conditions.
    • (2) When the Hotel is fully booked and no room is available.
    • (3) When the Guest seeking accommodation is deemed liable to conduct him / herself in a manner that will contravene the law or act against public order or good morals in regard to his or her accommodation.
    • (4) When the Guest seeking accommodation can be clearly determined to be carrying an infectious disease.
    • (5) When the Hotel is requested to assume an unreasonable burden in regard to his or her accommodation.
    • (6) When the Hotel is unable to provide accommodation due to natural calamities, disfunction of the facilities, or other unavoidable circumstances.
    • (7) When the provisions of Article 4 of the Kanagawa Prefectural Ordinance are application

RIGHT TO CANCEL ACCOMMODATION CONTRACTS BY THE GUEST

Article 6

  1. The Guest is entitled to cancel the Accommodation Contract by notifying the Hotel.
  2. In the case when the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable (except in the case when the Hotel has requested the payment of the deposit during the specified period as prescribed in Paragraph 2 of Article 3 and the Guest has cancelled before the payment), the Guest shall pay cancellation charges as listed in Table No.2. However, in the case when a special contract, as prescribed in Paragraph 1 of Article 4, has been concluded, the same shall apply only if the Guest is informed of the obligation of payment of cancellation charges in the case of cancellation by the Guest.
  3. In the case when the Guest does not appear by 8 p.m. of the accommodation date (or 2 hours after the expected time of arrival if the Hotel has been so notified) without advance notice, the Hotel may regard the Accommodation Contract as being cancelled by the Guest.

RIGHT TO CANCEL ACCOMMODATION CONTRACTS BY THE HOTEL

Article 7

  1. The Hotel may cancel the accommodation Contract in any of the following cases:
    • (1) When the Guest is deemed liable to contract or have conducted him / herself in a manner contract to the law or acts against public order and good morals in regard to his / her accommodation.
    • (2) When the guest can be clearly determined to be carrying an infectious disease
    • (3) When the Hotel is requested to assume an unreasonable burden in regard to his / her accommodation.
    • (4) When the Hotel is unable to provide accommodation due to natural calamities or other causes of force majeure.
    • (5) When the provisions of Article 4 of the Kanagawa Prefectural Ordinance are applicable
    • (6) When the Guest does not observer prohibited actions such as smoking in bed, tampering with the firefighting facilities, or other prohibitions of the Use Regulations stipulated by the Hotel (restricted to particulars deemed necessary in order to the Use Regulations stipulated by the Hotel (restricted to particulars deemed necessary in order to avoid the causing of fires).
  2. In the case when the Hotel has cancelled the Accommodation Contract in accordance with the preceding Paragraph, the Hotel shall not be entitled to charge the Guest for any services not received during the remainder of the contractual period.

REGISTRATION

Article 8

  1. The Guest shall register the following particulars at the front desk of the Hotel on the day of accommodation:
    • (1) Name, age, sex, address, and occupation
    • (2) Nationality, passport number, port and date of entry into Japan.
    • (3) Date and estimated time of departure.
    • (4) Other particulars deemed necessary by the Hotel.
  2. In the case when the Guest intends to pay his / her Accommodation Charges prescribed Article 12 by any means other than Japanese currency, such as traveler's cheques, coupons or credit cards, these credentials shall be shown in advance at the time of the registration prescribed in the preceding Paragraph.

OCCUPANCY HOURS OF GUEST ROOMS

Article 9

  1. The Guest is entitled to occupy the contracted guest room of the Hotel from 2 p.m. to 12 p.m. (noon).
    However, in the case when the Guest is accommodated continuously, the Guest may occupy the room all day long, excluding the days of arrival and department.
  2. The Hotel may, not withstanding the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the room beyond the time prescribed in the same Paragraph. In such case, extra charges shall be paid as follows:
    • (1) Until extension 2 hours p.m. 30% of the room charge.
    • (2) Until extension 5 hours p.m. 50% of the room charge.
    • (3) Later than extension 5 hours room charge in full.

OBSERVANCE OF USE REGULATIONS

Article 10

  1. The Guest shall observe the Use Regulations established by the Hotel, which are posted within the premises of the Hotel.

BUSINESS HOURS

Article 11

  1. The business hours of the main facilities, etc, of the Hotel are as follows, and those of other facilities, etc, shall be noted in detail by brochures, displayed notices, service directions in guest room, and other notices.
    • (1) Front Desk service 24 hours
    • (2) Service hours (at facilities) for dining, drinking, etc. Please refer to the Hotel Service Directory

PAYMENT OF ACCOMMODATION CHARGES

Article 12

  1. Calculations for the Accommodation Charges, etc. to be paid by the Guest are listed in Table No.1.
  2. Accommodation Charge, etc. as stated in the preceding Paragraph shall be paid with Japanese currency or by other means such as traveler's cheques, coupons or credit cards recognized by the Hotel at the front desk at the time of the Guest's departure or upon request by the Hotel.
  3. Accommodation Charges shall be paid even if the Guest does not voluntarily utilize the accommodation facilities provided him / her by the Hotel.

LIABILITIES OF THE HOTEL

Article 13

  1. The Hotel shall compensate the Guest for damages if the Hotel has caused such damages in the fulfillment or the non fulfillment of the Accommodation Contract or related agreements. However, the same shall not apply in cases where such damages have been caused due to reasons for which the is not liable.
  2. In addition to having received the STANDARD MARK (Certificate of Excellence in Fire Prevention Standard unexpected fire and other disasters.

HANDLING WHEN UNABLE TO PROVIDE CONTRACTED ROOMS

Article 14

  1. When unable to provide contracted rooms, the Hotel shall, with the consent of the Guest, arrange accommodation of the same standard elsewhere for the Guest insofar as practicable.
  2. When accommodation arrangement can not be made notwithstanding provisions of the preceding Paragraph, fee shall be applied to the reparations. However, when the Hotel can not provide accommodation due to causes for which the Hotel is not liable, the Hotel shall not compensate Guest.

HANDLING OF DEPOSITED ARTICLES

Article 15

  1. When any damage such as loss or damage occurs to items, cash, or valuables left with reception by guests, and with the exception of when such damage is caused by acts of providence, the Hotel shall compensate for such damage.
    However, in the event that the Hotel has asked to be informed of the nature and value of the cash or valuables, and when a guest has not informed the Hotel of such details, the Hotel shall limit the amount of compensation for damage to 100,000 JPY.
  2. Unless due to intent or gross negligence on the part of the Hotel, the Hotel shall not be responsible for damages such as loss or damage to items, cash or valuables brought into the Hotel by guests,

CUSTODY OF BAGGAGE AND BELONGINGS OF THE GUEST

Article 16

  1. When the baggage of the Guest is brought into the Hotel before his / her arrival, the Hotel shall be liable to keep it only in the case when such a request has been accepted by the Hotel. The baggage shall be handed over to the Guest at the front desk at the time of his / her check-in.
  2. In the case when baggage or belongings of the Guest are discovered left behind after his/her check-out, the Hotel shall keep the article at longest for 3 month including the day it is found, and after this period, the Hotel shall dispose of it.
  3. The Hotel's liability in regard to the custody of the Guest's baggage and belongings in the case of the preceding two paragraphs shall be assumed in accordance with the provisions of paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the same Article in the case of Paragraph 2.

LIABILITY IN REGARD TO PARKING

Article 17

  1. The Hotel shall not be liable for the custody of the Guest's vehicle when the Guest utilizes the parking lot within the Hotel premises, as it shall be regarded that the Hotel simply offers the space for parking, whether the key of the vehicle has been deposited to the Hotel or not. However, the Hotel shall compensate the Guest for damages caused through intention or negligence on the part of the Hotel in regard to the management of the parking lot.

LIABILITY OF THE GUEST

Article 18

  1. The Guest shall compensate the Hotel for damages caused through intention or negligence on the part of the Guest.

Remarks:

  1. The percentage signifies the rate of cancellation charge to the Basic Accommodation Charges.
  2. When the number of days contracted is shortened, the cancellation charge for the first day shall be paid by the Guest regardless of the number of days shortened.
  3. When part of a group booking (for 15 persons or more) is cancelled, the cancellation charge shall not be charged for the number of persons equivalent to 10% of the number of persons booked as of 10 days prior to the occupancy (when accepted less than 10 days prior to the occupancy as of the date of cancellation) with fractions counted as a whole number.

Hotel Usage Regulations (Draft)

The Hotel has established the following usage regulations in order that guests may use our facilities safely and in comfort, and we hereby ask for your cooperation in adhering to these regulations.

1. Scope of Application

These regulations shall apply to visitors who use any of the Hotel's facilities (including overnight accommodation facilities, banqueting facilities, restaurants, bars, clock rooms, the lobby, premises etc. Hereinafter collectively referred to as the 'various facilities within the Hotel'); subject to the provision that accommodation contracts, banqueting and function regulations, and wedding reception regulations shall be applied to matters not provided for in these regulations.

2. Fire Prevention and Security Matters

  1. Smoking is not permitted other than in the designated smoking areas.
  2. Guests are not permitted to enter facilities other than areas for guests such as the back yard, emergency stairs and machinery rooms.

3. Handling of Items Left at the Hotel and Lost Property

  1. In principle, items left with the Hotel shall be disposed of by the Hotel after three (3) months have elapsed from the day of being left at the Hotel.
  2. Lost and found items shall be handled in accordance with the law.

4. Prohibition of the Use of the Facilities by Antisocial Forces

  1. The Hotel reserves the right to refuse to allow the following organizations and individuals to use the various facilities within the Hotel.
    1. Crime syndicates, members of crime syndicates, organizations affiliated with crime syndicates and persons affiliated with such organizations.
    2. Persons connected to corporations and other organizations, the operations of which are
      controlled by crime syndicates or members of crime syndicates.
    3. Anti social organizations, members of anti social organizations and persons affiliated with
      such organizations
    4. Persons acknowledged as having engaged in violence, injury causing acts, intimidating acts,
      the threatening of undue claims or similar acts.
    5. Persons for whom it is difficult to ensure their own personal safety such as people with
      identity crises' due to having a weak physical and mental state, taking drugs etc and persons
      who are in danger of causing danger, sense of fear, or anxiety in other guests.
    6. Persons who have been warned by the Hotel with regard to 'Other Prohibited Matters'
      provided for in article 5 below and who do not stop to cease such behavior immediately.
  2. In the event of (i) or (iii) above, the Hotel reserves the right to refuse to allow such persons to use any of the facilities from that point onwards.

5 Other Prohibited Matters

  1. Behavior at the various facilities within the Hotel which disturbs other guests such as loud voices, singing loudly, or noisy behavior.
  2. Bringing objects into the various facilities within the Hotel which, disturb other guests: i) Animals and all kinds of pets such as dogs, cats, birds etc (not including guide dogs and service dogs)
    1. Explosive or flammable products which ignite or catch fire easily, dangerous objects, objects that emit foul odors, an extremely large quantity of items, items possession of which have been prohibited by other laws and regulations.
  3. Gambling, or behavior which corrupts public morals and public peace at the various facilities within the Hotel.
  4. Distribution of advertising or PR materials, the sale of products, or the conducting of business without permission at the various facilities within the Hotel.
  5. Conduct such as the distribution of fliers or providing autographs without permission at the various facilities within the Hotel.
  6. Leaving personal belongings in corridors, lobbies etc
  7. Altering the current state of the Hotel such as damaging buildings or facilities or adding extraneous substances etc.
  8. Smoking in areas which could easily cause fire such as in bed.
  9. Leaving guest rooms whilst wearing night wear or slippers etc.
  10. Other conduct deemed as being inappropriate by the Hotel.

Supplementary Provisions

These regulations are effective from MM DD, 2008.
